IDENTIFICACIÓN DE LAS COMPAÑÍAS

CONCEPTOS CLAVE

1)      Aviso de privacidad: Documento físico, electrónico o en cualquier otro formato generado por el Responsable que se pone a disposición del Titular para el tratamiento de sus datos personales. En el Aviso de Privacidad se comunica al Titular la información relativa a la existencia de las políticas de tratamiento de información que le serán aplicables, la forma de acceder a las mismas y la finalidad del tratamiento que se pretende dar a los datos personales.

2)      SITIO WEB: alude al sitio de internet utilizado por el cliente y creado para la publicación de los servicios que ofertan SURGEON PLUS CORP y SURGEON PLUS S.A.S., al cual se accede mediante el vínculo: https://surgeon.plus/

También hace referencia al aplicativo que usan los clientes al crear un usuario y contraseña para acceder a los servicios de SURGEON PLUS CORP y SURGEON PLUS S.A.S.

3)      COMPAÑÍAS: hace referencia, de manera conjunta, a SURGEON PLUS CORP y SURGEON PLUS S.A.S.

POLÍTICAS Y FINALIDADES DEL TRATAMIENTO DE DATOS PERSONALES

Las COMPAÑÍAS son responsables del tratamiento de los datos personales que han sido recolectados y conservados en sus bases de datos y que se efectúa conforme a sus Políticas de Privacidad y Tratamiento de Datos, las cuales puede consultar en https://surgeon.plus/, donde podrá encontrar todo lo concerniente acerca de las políticas para el tratamiento de la información recogida, así como los procedimientos de consulta y reclamación que le permitirán hacer efectivos sus derechos.

El tratamiento de sus datos personales tiene las siguientes finalidades:

·         Desarrollar el objeto social de las COMPAÑÍAS, específicamente para la administración y operación de la Plataforma de Soluciones Médicas «Surgeon Plus» (compuesta por una plataforma CRM y una página web) mediante la cual se conectan:

(i)                  los Profesionales de la Salud, quienes ofrecen servicios médicos a través de la Plataforma de Soluciones Médicas «Surgeon Plus»;

(ii)                los Usuarios Finales de los Profesionales de la Salud, quienes adquieren los servicios médicos ofrecidos por los Profesionales de la Salud.

·         Prestación de los servicios ofrecidos por las COMPAÑÍAS.

·         Ejecución de los contratos suscritos con las COMPAÑÍAS.

·         Servicio al cliente y mercadeo.

·         Envío de información relacionada con novedades legales y regulatorias de interés para los clientes de las COMPAÑÍAS.

·         Envío de información respecto de la relación contractual.

·         Envío de la información estrictamente necesaria a los Profesionales de la Salud con los que los clientes realicen gestiones médicas como consecuencia de los servicios prestados por las COMPAÑÍAS.

·         Registro de información estadística de clientes de las COMPAÑÍAS.

·         Registro de información de proveedores y contratistas.

·         Registro de información de los empleados de contratistas que prestan servicios en las COMPAÑÍAS.

·         Estadísticas contractuales y de servicios ofrecidos o prestados.

·         Comunicación, consolidación, organización, actualización, control, acreditación, aseguramiento, estadística, reporte, mantenimiento, interacción, y gestión de las actuaciones, informaciones y actividades en las cuales se relacionan o vinculan a los proveedores, contratistas y empleados de las COMPAÑÍAS.

·         Para notificar a familiares y a cualquier servicio de atención prioritaria en caso de emergencias que se relacionen con los servicios prestados por las COMPAÑÍAS.

·         Comunicación, registro, archivo, organización, tramitación y gestión de las actuaciones, estrategias, y actividades en las que se vinculan los accionistas de las COMPAÑÍAS.

·         Acceder, consultar, comparar y evaluar toda la información que sobre los Titulares de los datos personales se encuentre almacenada en las bases de datos de cualquier central de riesgo crediticio, financiero, de antecedentes judiciales o de seguridad legítimamente constituida, de naturaleza estatal o privada, nacional colombiana o extranjera.

·         Investigar, verificar y validar la información suministrada por los Titulares de los datos personales, con cualquier información de la que las COMPAÑÍAS legítimamente dispongan.

·         Consultar, comparar y evaluar toda la información que sobre los Titulares se encuentre almacenada en las bases de datos de centrales de riesgo crediticio, financiero, de antecedentes judiciales o de seguridad legítimamente constituida, de naturaleza estatal o privada, nacional o extranjera.

En caso de que las COMPAÑÍAS no se encuentre en capacidad de realizar el Tratamiento por sus propios medios, podrá transferir los datos recopilados para que sean tratados por un tercero, previa notificación a los Titulares de los datos recopilados, el cual será el encargado del Tratamiento y deberá garantizar condiciones idóneas de confidencialidad y seguridad de la información transferida para el tratamiento.

Finalmente, se le informa que usted como titular de los datos personales tiene los siguientes derechos:

a) Conocer, actualizar y rectificar sus datos personales;

b) Solicitar prueba de la autorización;

c) Ser informado respecto del uso que le ha dado a sus datos personales;

d) Presentar quejas ante la Superintendencia de Industria y Comercio (autoridad en asuntos de tratamiento de datos personales en el territorio colombiano);

e) Acceder en forma gratuita a sus datos personales que hayan sido objeto del tratamiento;

 f) Revocar y/o suprimir sus datos personales, para lo que podrá contactarnos en:

KEY CONCEPTS

1)      Privacy Notice: A physical, electronic or any other format generated by the Controller that is made available to the Data Subject for the processing of personal data. The Privacy Notice communicates to the Data Subject the information regarding the existence of the information processing policies that will be applicable to him/her, how to access them and the purpose of the processing that is intended to be given to the personal data.

2)      WEBSITE: refers to the internet site used by the client and created for the publication of the services offered by SURGEON PLUS CORP and SURGEON PLUS S.A.S., which is accessed through the link: https://surgeon.plus/

It also refers to the application used by customers to create a username and password to access SURGEON PLUS CORP and SURGEON PLUS S.A.S. services.

3)      COMPANIES: refers, collectively, to SURGEON PLUS CORP and SURGEON PLUS S.A.S.

POLICIES AND PURPOSES OF PERSONAL DATA PROCESSING

The COMPANIES are responsible for the processing of personal data that has been collected and stored in their databases and that is carried out in accordance with their Privacy and Data Processing Policies, which you can consult at https://surgeon.plus/, where you can find everything concerning the policies for the processing of the information collected, as well as the consultation and complaint procedures that will allow you to enforce your rights.

The processing of your personal data has the following purposes:

·         To develop the social object of the COMPANIES, specifically for the administration and operation of the Medical Solutions Platform «Surgeon Plus» (composed of a CRM platform and a web page) through which they are connected:

(i)                  Health Professionals, who offer medical services through the «Surgeon Plus» Medical Solutions Platform;

(ii)                 the End Users of the Health Professionals, who purchase the medical services offered by the Health Professionals.

·         Provision of services offered by the COMPANIES.

·         Execution of the contracts signed with the COMPANIES.

·         Customer service and marketing.

·         Sending of information related to legal and regulatory developments of interest to COMPANY customers.

·         Sending information regarding the contractual relationship.

·         Sending the strictly necessary information to the Health Professionals with whom the clients carry out medical procedures as a consequence of the services provided by the COMPANIES.

·         Registration of statistical information of clients of the COMPANIES.

·         Registration of supplier and contractor information.

·         Registration of information on the employees of contractors who provide services in the COMPANIES.

·         Contractual statistics and statistics on services offered or rendered.

·         Communication, consolidation, organization, updating, control, accreditation, assurance, statistics, reporting, maintenance, interaction, and management of the actions, information and activities in which the suppliers, contractors and employees of the COMPANIES are related or linked.

·         To notify family members and any priority care services in case of emergencies related to the services provided by the COMPANIES.

·         Communication, registration, filing, organization, processing and management of the actions, strategies and activities in which the shareholders of the COMPANIES are involved.

·         Access, consult, compare and evaluate all the information about the Personal Data Holders stored in the databases of any credit, financial, judicial or security risk center legitimately constituted, of state or private, Colombian or foreign national nature.

·         Investigate, verify and validate the information provided by the Personal Data Holders, with any information that the COMPANIES legitimately have.

·         To consult, compare and evaluate all the information about the Holders that is stored in the databases of credit, financial, judicial or security risk centers legitimately constituted, of state or private, national or foreign nature.

In the event that the COMPANIES is not able to carry out the Processing by its own means, it may transfer the data collected to be processed by a third party, prior notification to the Data Controllers of the data collected, which will be in charge of the Processing and must ensure appropriate conditions of confidentiality and security of the information transferred for processing.

Finally, you are informed that you as the owner of the personal data have the following rights:

a)  To know, update and rectify your personal data;

b)  Request proof of authorization;

c)  Be informed about the use that has been made of their personal data;

d)  File complaints before the Superintendence of Industry and Commerce (authority in matters of personal data processing in the Colombian territory);
